Thug brothers in pub face mask row threatened staff then aimed vile abuse at cops

Two brothers who refused to wear face masks in a pub later aimed vile abuse at police officers called by frightened bar staff.

Barry Rutherford, 29, and Lee Rutherford, 28, threatened workers at pubs in East Lothian before being arrested by cops.

The older sibling had to be taken to hospital by worried officer due to his drunkenness.

Barry Rutherford aimed racist and homophobic abuse at constables as they transported him in a police car.

Brother Lee also targeted an officer with a homophobic remark during the incident last month.

The pair appeared at Edinburgh Sheriff Court yesterday and admitted various charges.

Fiscal depute Sarah Noon said the men entered The Eagle Inn pub in Dunbar on September 17 at around 1.50pm.

Ms Noon said neither was wearing a face mask and, when asked to do so by a bar worker, they “took umbrage”.

The court was told they were refused service and asked to leave with Barry Rutherford responding: “F*** off, I’ll remember your face.”

Ms Noon said the brothers visited the Golf Tavern in Haddington at around 8.30pm that evening to ask about booking accommodation.

After being refused, the court heard Lee Rutherford told staff: “I’ll be waiting for you after work, you’ll be getting it.”

Police traced the pair soon afterwards and Barry Rutherford called Pc Mohammad Iqbal a “black b******” and said “go back home”. He also called Pc Iqbal and Pc Dermott Maughan “p**fs”

His brother called Pc Kevin Hughes a “f****** p**f”, the court heard.

Ms Noon said officers made a decision to take Barry Rutherford to Edinburgh Royal Infirmary due to the “level of his intoxication”.

She said Pc Iqbal was looking after him at the hospital when Rutherford attempted to bite him.

Barry Rutherford, of Port Seton, and Lee Rutherford, of Musselburgh, both admitted behaving in a threatening or abusive manner, shouting, swearing, and uttering threats.

The older brother, who appeared from custody, also pled guilty to making racist and homophobic remarks and assaulting Pc Iqbal.

His sibling admitted making a homophobic remark to an officer.

Sheriff Kenneth McGowan deferred sentence on them until next month for reports and released them on bail.
