SC refuses to hear PIL seeking directions for Nupur Sharma's arrest

NEW DELHI: The Supreme Court on Friday refused to entertain a PIL seeking directions to authorities to arrest former BJP spokesperson Nupur Sharma over her remarks against Prophet Mohammad. A bench of Chief Justice U U Lalit and Justices S Ravindra Bhat and P S Narasimha said the courts cannot pass such orders and should be careful while passing directions in such cases. “This may sound simple and innocuous but it has far-reaching consequences. The court should be circumspect while issuing directions. We would suggest you withdraw your plea,” the bench observed. The petitioner then withdrew the plea.

The apex court last week refused to entertain a petition seeking arrest of Syed Waseem Rizvi alias Jitendra Tyagi and Yati Narasinghanand in the Haridwar dharam sansad hate speech cases. The court had said that such an order cannot be passed in a PIL and the petitioner should raise his grievances before the appropriate authority by filing a police complaint.

The SC in July had ordered no coercive action against Sharma be taken in the multiple FIRs filed across the country against her.
