SACRAMENTO, Calif. _ A Sacramento County judge has sentenced a south Sacramento man convicted of murder for shooting his neighbor, who called 911 to complain about a large party with loud music and about 100 attendees.
Superior Court Judge Laurie Earl on Friday sentenced Mario Junior Garcia to 40 years to life in prison for the August 2016 death of Talanoa Feinga, the Sacramento County District Attorney's Office announced Monday in a news release.
Feinga was a 27-year-old husband and father of two children. Days after the shooting, Feinga's family told The Sacramento Bee that the victim was unarmed when he was gunned down.
Less than a month before Feinga's death, his Valley Hi duplex home in the 8300 block of Anton Way was struck by gunfire after another of Garcia's large parties, prosecutors said.
A jury on Oct. 1 found Garcia guilty of second-degree murder, along with an enhancement for using a gun in Feinga's killing.
Prosecutors said Garcia, 22, behaved recklessly in the neighborhood, hosting large parties with loud music and alcohol.
After one of those parties on July 17, 2016, shots were fired outside of Feinga's home. One bullet went through Feinga's living room window and struck an interior wall; four other bullets hit parked cars in front of the home, according to prosecutors.
Feinga reported the July shooting to police and confronted Garcia about damage to his home. Prosecutors said Garcia agreed to pay for some of the damage, but he never paid Feinga.
On Aug. 8, 2016, Garcia hosted another large party. Feinga and other neighbors called authorities to try to shut down the party, according to prosecutors. Feinga and his neighbors also tried to speak to Garcia.
Garcia and Feinga began arguing. Prosecutors said Garcia � who was 19 years old at the time � pulled out a gun without warning and shot Feinga three times in the chest.
An injured Feinga retreated to his home, where his wife and other relatives tried to stop the bleeding, according to prosecutors. Feinga was taken to a hospital, where he died.
Garcia left the scene, but he surrendered to authorities about 36 hours after the fatal shooting.
