Passengers forced to 'stand in the rain' while train driver took break

People were forced to "stand in the rain" after a train was terminated for the driver to take his break.

Passengers were told to get off the train at Formby station yesterday evening because the driver had to avoid surpassing the legal limit of hours he could work without a break.

As a result, one frustrated passenger claimed people were forced to stand in the rain.

Merseyrail took to Twitter to explain that their Southport to Hunts Cross service would be starting from Formby train station.

In their tweet they said: "Following an earlier trespass incident, the 20:07 Southport-Hunts Cross will start from Formby at 20:22, calling all stations to Hunts Cross."

This is when Andrew Gardiner replied explaining his frustration with the termination of his train at Formby.

He tweeted: "To terminate this service at Formby and expect people to wait 27 minutes for the next service to Southport is completely unacceptable.

"Don't use the earlier incident as an excuse. It would be understandable if the next service was closer."

However, the termination was said to have been caused by delays from a trespasser on the tracks.

Merseyrail were quick to explain the situation.

They responded: "Please be assured that our controllers were working extremely hard to rectify this during a challenging situation. This service had to depart at Formby due to legal drivers hours. Thank you."

Due to laws around driving, the driver must take a 30 minute break if they have been driving for eight hours.

Andrew Gardiner tweeted back: "So he couldn't have driven to Southport and had a taxi back to his home depot?"

To which Merseyrail explained that if the service hadn't have terminated at Formby, further delays and cancellations would have happened across the network.

They wrote: "If the driver had gone on to Southport, they would have been over their legal hours. Which would mean they were unable to drive for the rest of the evening, resulting in further delays and cancellations. Thank you."

A Merseyrail spokesperson told the ECHO : "Due to disruption in Aigburth last night, to ensure a driver was able to have his physical needs break a service to Southport was terminated at Formby.”
