Mumbai: Yug Tuli gets bail in 2017 Kamala Mills rooftop fire case

MUMBAI: The Bombay high court has granted bail to Yug Tuli, co-owner of Mojo’s Bistro, accused in the Kamala Mills roof top fire of December 29, 2017. He was in custody for 11 months before the Supreme Court had released him on interim bail in December 2018, pending his plea before the HC.

The HC finally took up the bail plea for hearing and disposal post the Covid-19 pandemic and on June 22, Justice AS Gadkari directed his release on bail observing that there was no breach of any conditions imposed on him for the interim bail since December 2018.

Tuli’s counsel Rajiv Chavan said co-accused Yug Pathak, partner at the Bistro was granted bail by the SC in December 2018 and sought parity. Prakash Shetty the special public prosecutor, the HC noted, “with his usual fairness at command submitted that, all the accused persons in the present crime including co-accused Yug Pathak who is similarly situated have been released on bail.’’

Tuli, others were charged for culpable homicide not amounting to murder after the blaze that broke out in two rooftop restaurants—1Above and Mojo’s Bistro-- killed 14 persons.

The HC noted that Tuli's bail was rejected by it on 27th April 2018. He had then challenged the denial before the SC by way of a petition for Special Leave to Appeal and the SC had by its Order dated 29th May 2018 dismissed it but granted liberty to him to move a fresh Application for bail after three months. Tuli had accordingly filed an Application for bail before the Trial Court. The Trial Court by its Order dated 24th October 2018, rejected the Application. He had then moved the HC and pending that filed anSLP before the SC which then considering that eh was incarcerated for almost 11 months directed his release on interim bail till matter is taken up by the high court.
