Melbourne man jailed over deadly road rage bashing

The roadside bashing of Phi Long Ung happened in full view of motorists

A Melbourne man has been sentenced to more than a decade in prison for bashing a man to death in a road rage incident in Melbourne's west.

Christopher Orfanidis, 33, from Sunshine West, pleaded guilty to the manslaughter of Phi Long Ung, 37, at Ardeer in 2015.

He appeared at the Supreme Court of Victoria on Tuesday afternoon, where Justice Christopher Beale sentenced him to 10 years for manslaughter and two years for intentionally causing injury.

Mr Ung's death followed an argument over a parked car and a high-speed pursuit on the Western Ring Road on July 5, 2015.

The altercations began two days earlier, when Mr Ung's associate, referred to in court as Witness A, parked opposite Orfanidis' home on Libby Lane in Sunshine West.

Orfanidis politely asked Witness A to move the car, which he did.

Two says later, Orfanidis and his associate, referred to in court as X, saw Witness A parked in the same place, with Mr Ung as a passenger.

An argument broke out and became violent, punching and kicking the car and breaking off a side mirror.

Gun shot, high-speed chase before deadly bashing

Witness A and Mr Ung then drove away, but came back, at which point Mr Ung leaned out the passenger window and told Orfanidis to "f*** off unless you want trouble."

Orfanidis threatened to kill them if they came back to the street and Mr Ung responded by threatening to kill Orfanidis.

Justice Beale said Mr Ung then pulled out a rifle and fired a shot, although it was unclear exactly when this happened.

A high-speed pursuit began with Orfanidis and X chasing Witness A and Mr Ung on the Western Ring Road.

A speed camera detected Orfanidis travelling at 123kmph and the two cars collided twice, resulting in Witness A's car spinning out of control on the Ballarat Road off-ramp, before hitting a guard rail and coming to a stop.

In full view of the public, Orfanidis and X then launched an horrific attack on Mr Ung and Witness A.

"You and X got out of your car and Witness A and Ung got out of theirs," Justice Beale said.

"Mr Ung was armed with his rifle, which you rested from his grip.

"You then struck him forcefully to the head at least twice with the wooden frame of the rifle.

"You also kicked him whilst he was curled up on the ground.

"At the same time, X was punching and kicking and stomping on Witness A.

"You went over to Witness A and also hit him a few times as he lay on the ground, pleading for you to stop."

Victim never regained consciousness

Orfanidis and X then drove away, while their victims were taken to Royal Melbourne Hospital.

Mr Ung never regained consciousness, and died 16 days later from severe head injuries.

Witness A suffered a fractured rib, fractured finger, lung lacerations and bruising and lacerations to the head.

Justice Beale said he accepted Mr Ung had provoked Orfanidis, but only after Orfanidis had launched the initial provocation.

He described Orfanidis as "the aggressor" and said he had numerous opportunities to step back form the conflict.

In delivering the sentence of 10 years for the manslaughter of Mr Ung and two years for intentionally injuring Witness A, Justice Beale ordered that six months be served cumulatively, leaving a total prison term of 10 years and six months, with a non-parole period of seven years.

Orfanidis has served 802 days in pre-sentence detention, meaning he will be eligible for parole in 2022.
