Man who admitted role in fatal one-punch attack back in custody

A man who pleaded guilty over the one-punch attack on 18-year-old Cole Miller during a night out in Brisbane's Fortitude Valley is back in custody and faces deportation.

Daniel Jermaine Lee Maxwell walked free from the Supreme Court on Thursday afternoon after being sentenced to 18 months in jail.

The New Zealand national was charged with unlawful striking causing death but that was downgraded to two counts of common assault and one count of affray.

Given he had already spent 19 months in jail, the sentence was suspended and he was released.

But on Thursday evening the Federal Government confirmed Maxwell had been taken back into custody, this time by Australian Border Force officers.

Maxwell could now be deported back to New Zealand, given he has served a sentence longer than 12 months.

Mr Miller was walking through a mall in January 2016 when he was set upon by Maxwell in an unprovoked attack.

Armstrong Renata, 22, who was with Maxwell, delivered a single punch that caused the teenager to fall and hit his head on the pavement.

Renata has pleaded guilty to unlawful striking causing death, which carries a maximum penalty of life imprisonment.

He will be sentenced at a later date.
