Man sues Will County jail claiming fellow inmate threw urine at him

Jan. 13--A Bolingbrook man who is an inmate in the Will County Adult Detention facility has filed a suit against the jail, claiming another inmate repeatedly threw urine on him and that jail officials did not allow him to press charges.

The lawsuit, filed in December by 22-year-old Jesus M. Simms, who represents himself in the case, states that he put in multiple grievances against another inmate who Simms claims threw urine on him.

The other inmate is not named as a defendant in the lawsuit.

Simms filed the grievances with the authorities on Aug. 1 and Aug. 2, the lawsuit states, and told them he wanted to press charges.

But jail officials told Simms that he could not press charges, according to the lawsuit.

The jail is "violating my constitutional rights," the lawsuit states.

Simms is awaiting trial and is being held at the jail on $250,000 bond for aggravated robbery and robbery charges, both felonies, according to Will County State's Attorney's Office spokesman Charles Pelkie.

He was booked at the jail on Jan. 6, 2014, according to the site.

Will County officials declined to comment, citing the ongoing nature of the litigation.

County court records show that the urine complaint is not Simms' only ongoing case where he is representing himself.

In September he filed a defamation lawsuit against two people he claims are his siblings and told elders at Simms' church that Simms was arrested for prostitution.

The defendants could not be reached for comment.
