Man sentenced for 'frightening' attack over littering

A young Queensland man who attacked a 72-year-old's car with a baseball bat and was later caught with a commercial quantity of drugs has been sentenced to three years' imprisonment.

Will Warren, 22, was sentenced in the Brisbane Supreme Court on Thursday after pleading guilty to a string of charges relating to a 12-month period starting with his violent outburst during a dispute about littering and later being twice caught with drugs during police raids.

Warren, from Tambourine, was captured by security cameras using a bat and his fist to smash the windscreen and windows of the older man's car on November, 2020 at a Yarrabilba shopping centre in Logan.

Justice Elizabeth Wilson said the victim had seen someone in Warren's car throw a piece of rubbish from the window so he picked it up and knocked on the passenger side window.

The passenger refused to take the rubbish back so the man placed it between the windshield and bonnet of Warren's car.

Warren ran towards the victim's car 10 minutes later while he was reversing out of a car park.

"You yelled 'You want to hit my car?' as you struck the (victim's) windshield with a baseball bat, smashing it. The (victim) continued to reverse away as you struck the passenger side window, completely smashing it ... glass fell inside and cut (the victim)," Justice Wilson told Warren.

Warren demanded the victim open the door and tried to get inside but the doors were locked.

Warren also ignored his passenger telling him to stop the attack as it was "all over a bit of rubbish".

Justice Wilson said Warren's attack was a "brutal overreaction" and the other man had done nothing wrong or provocative.

"Words cannot adequately describe your conduct on that day but the video bears all. I hope that when you watched that ... you felt extreme shame for your behaviour," Justice Wilson said.

"Frightening experience for the complaint. No person needs to go through that amount of sheer violence."

Warren was caught by police executing a search warrant on December 15, 2020 with 26 grams of methylamphetamine, opiate painkillers and small quantities of other drugs.

Warren was later granted bail and was then caught in another raid with 7.94 grams of cocaine in two plastic bags that he tried to flush down the toilet when police arrived.

Justice Wilson said this was aggravated possession of a commercial quantity of cocaine and the most serious charge Warren faced.

Justice Wilson said she accepted the defence's submission that Warren was a young offender aged just 20 when he committed wilful damage and attempted unlawful entry of a vehicle while armed.

Warren's barrister also submitted his client had no prior criminal record, was employed as a tiler and had plans to start a new business.

Warren was released on parole having served 45 days in custody and he was ordered to pay $1000 compensation to the victim.
