Pilot program launched for in-country H-1B Visa renewals

Renewal of H-1B visas within the United States commenced with a pilot program in 2023. Earlier in the year, the US State Department introduced a limited rollout of the H-1B domestic visa renewal pilot, permitting a restricted 20,000 participants to renew their visas. As part of this initiative, applicants are mandated to submit their visas to the State Department and are restricted from travelling outside the US. However, it's important to note that while H-1B employees can renew their visas without departing the country, their spouses are not eligible for this process.

Restrictions on H-1B registration implemented

In 2023, the US Government implemented stringent measures to address the over-representation issue in H-1B visa registrations. The updated regulations mandate a singular registration per employee, compelling employers to now provide passport information for each registrant. Nicholas A. Mastroianni III, President and CMO of US Immigration Fund (USIF), offered his perspective on the matter, expressing that these adjustments aim to diminish the artificial inflation of applicants' probabilities in the H-1B lottery system. The objective is to establish a more efficient and equitable selection process, ultimately enhancing the fairness and integrity of the H-1B visa program.

Revolutionising visa applications in 2023

In 2023, the US Government revealed a pioneering online visa application system, which further simplified the process and reduced paperwork. This digital platform marked a noteworthy advancement, improving efficiency for applicants. Reports add that the modernisation of the visa application process is aimed at making it more accessible and efficient for applicants around the world.

EB-5 visa applicants experience policy revisions

In October 2023, USCIS (United States Citizenship and Immigration Services) adjusted the EB-5 visa policy to align with the EB-5 Reform and Integrity Act of 2022. The update specifies that if an EB-5 investor manages to generate 10 jobs, they can be reimbursed after two years while remaining eligible for a US green card. The USCIS also significantly enhanced the processing speed for EB-5 visa applications this year.

Updated Student Visa policies

The United States announced a rise in processing fees for F, M, and J visas, aligning with the expenses associated with the processing carried out by American consular officials. Furthermore, consular officers now exercise increased discretion in reviewing visa applications from students, emphasising the current intent of applicants rather than rigid residency prerequisites.
