Drunk Edinburgh man caught with lover in stairwell as neighbour tried to get past

A drunk Edinburgh man carried out a sex act on a woman as a tenement resident tried to squeeze past them on the common stairwell.

Keith Ballentine didn’t stop despite the shocked neighbour in the Edinburgh flats being blocked on his way to leave.

The resident called the police and, when officers arrived sometime later, the pair were still performing sexual acts.

Ballentine, 47, appeared at the city’s sheriff court on Thursday and admitted committing an offence of public indecency.

The woman, Kimberley Finnigan, 41, pled guilty to the charge at a previous hearing and did not appear, the Record reports.

Fiscal depute Morgan Beattie said it was around noon when the resident left his flat in Lochrin Terrace in the capital’s Tollcross area.

Ms Beattie said the man spotted Ballentine and Finnigan kissing at the bottom of the stairwell.

She said: “As he reached the last flight of stairs, he looked down and saw Ms Finnigan reclining on the lower steps with her underwear lowered to her ankles.”

The prosecutor said Ballentine was seen “performing oral sex on Miss Finnigan” and the resident was left feeling “shocked and disgusted”.

Ms Beattie said: “As he walked past the accused, the accused continued to perform oral sex on Ms Finnigan. Neither of them stopped or moved to let (the man) past.”

The court heard the resident called the police and constables arrived at the scene on December 23 2020.

Ms Beattie said: “The accused and Ms Finnigan were still engaged in sexual acts. The accused stated to police that he was sorry and shouldn’t have done it.”

Solicitor Gagan Kaur said her client “completely regrets his behaviour and was “drunk at the time”.

The solicitor said Ballentine was “genuinely remorseful” and had since reduced his alcohol intake.

Sheriff Matthew Auchincloss deferred sentence on Ballentine, of the city’s New Town, until November for reports.

The sheriff noted Finnigan, of the Newhaven area, had previously pled guilty.
