Sentence over NSW officer's death delayed

The sentencing of a father-of-two for running a red light and killing an off-duty police officer has been delayed.

Constable Aaron Vidal, an expectant father in his dream career alongside his father in the NSW Police Force, was killed on his way home from work on June 18, 2020.

The four-year army veteran's motorcycle was hit by a car driven by tradie Tommy Balla, who had run a red light in an intersection in Sydney's Hills District.

Judge Stephen Hanley was due to sentence Balla, 38, on Tuesday afternoon.

But hours earlier, the hearing was vacated.

The case will be next mentioned on Friday, to set a new date for sentence.

Balla, who is on bail, broke down repeatedly at a sentence hearing on June 4, saying he was sorry and hadn't seen the arrow signal turn red.

The Crown challenged that idea, submitting that running the red arrow was a calculated risk.

The only sentencing option was jail, prosecutor Monika Knowles said.

But Balla's lawyer submitted his deep remorse, insight, apology, own trauma from the crash and lack of criminal offending meant home detention was an option.

"Other than what happened that evening, the community is safe from this offender," Rose Khalilizadeh said.

In November, father-of-six Warwick Mirzikinian was placed on a 19-month intensive corrections order for causing a fatal crash.

Mirzikinian veered into a kerbside lane in Double Bay while blinded by the sun and hit UberEats delivery cyclist Julien Trameaux.
