Justice Madhav Jamdar set aside a family court order that declined to waive the statutory six-month cooling-off period for the player’s divorce proceedings under the Hindu Marriage Act, noting the couple also satisfied the requirement of living separately.
The HC directed the family court to pass orders in the cricketer’s divorce plea by Thursday considering his participation in the upcoming IPL.
Section 13B of the Hindu Marriage Act provides for a six-month cooling-off period for couples seeking divorce with mutual consent to reconsider their decision and reconcile their differences.
Justice Jamdar was hearing a joint petition filed earlier this month by the cricketer and his wife who challenged the February 20 family court order. The couple sought divorce based on mutual consent.
