Aldi announces return of Cuthbert the Caterpillar after M&S legal battle

Aldi UK bosses have announced the return of controversial cake Cuthbert the Caterpillar.

Set to return to the supermarket shelves on June 6 of this year, Aldi took to social media following a legal battle with Marks and Spencer.

And now in a dig to the supermarket who are known for Colin the Caterpillar, Aldi have taken to the streets to announce the big news writing: "Where else would we announce it? #CuthBack."

The German discount chain was seen with an advert on a parked a truck with the driver and Cuthbert in hand and later they uploaded a video to TikTok which to date has gained almost two million views and a whole host of comments backing the store.

According to Hull Live, M&S settled its copyright row with Aldi in February of this year amid accusations the discounted retailer copied the design of its Colin the Caterpillar cake.

Despite an agreement having been made, the stores said they were unable to release details of the “confidential” deal which M&S first launched in April 2021 with the hopes Aldi would remove the animal themed cake from its shelves and not to sell a product similar in the future.

Deputy Master Timothy John Bowles signed off an agreement in a consent order filed at the High Court. The order allowed the legal claim to be withdrawn and said the retailers had reached a “confidential agreement” in November.

An M&S spokesman said: “The objective of the claim was to protect the IP (intellectual property) in our Colin the Caterpillar cake and we are very pleased with the outcome.”

M&S and Aldi are also involved in a separate copyright dispute over allegations the German rival copied an M&S “light-up” gin liqueur product.

The M&S spokesman added: “Like many other UK businesses, large and small, we know the true value and cost of innovation and the enormous time, passion, creativity, energy and attention to detail, that goes into designing, developing and bringing a product to market and building its brand over many years.

“So it is understandable that we want to defend our intellectual property and protect our suppliers – many of them small businesses that have worked with us for decades.”

In response to Aldi's viral TikTok many were quick to comment with one saying: "Aldi's social media guy needs a pay rise."

Another added: "This… this is marketing."
