NEW DELHI: Former India cricketer Yuvraj Singh has issued two separate legal notices to two Delhi-based real estate firms, citing breaches related to privacy rights and delayed possession of a property. The notices, invoking arbitration clauses, have been dispatched in response to alleged infringements by the firms.
The first notice, sent by Rizwan Law Associates on behalf of Singh, addresses delays in the completion and possession of a dwelling unit that Singh booked in 2020 at Hauz Khas, New Delhi. The notice is directed at M/s Brilliant Etoile Private Limited and M/s Uppal Housing Private Limited.
It demands "adequate damages in terms of delay caused in completion of the Project and issuance of the Letter of Possession in the absence of any reasonable cause or extension in timeline." Additionally, it seeks the delivery of an apartment that matches the promised quality, as Singh claims to have been offered a significantly inferior unit.
The second notice, issued solely to Brilliant Etoile Private Limited, pertains to the alleged misuse of Singh’s image and privacy rights. According to the notice, Singh had entered into a Memorandum of Understanding (MoU) with the firm on November 24, 2020, agreeing to promote and endorse their project. The MoU expired on November 23, 2023, yet Singh claims that the company continued to use his photographs on billboards, project sites, social media posts, and articles beyond the agreed period.
The notice states that the continued use of Singh's image and endorsements constitutes a breach of his Intellectual Property Rights, including Copyright, Personality Rights, and Right to Publicity.
"This dispute principally concerns with the violation of Intellectual Property Rights with respect to the Personality Rights and misuse of Brand Value of the Celebrity i.e., My Client in contravention to the terms of the Memorandum of Understanding dated 24.11.2020," the notice elaborates.
Yuvraj Singh has emphasized that the unauthorized use of his likeness post the MoU's expiry is a severe infringement on his rights, warranting legal action. The cricketing icon is seeking both rectification and compensation for the breaches cited in the legal notices.
