Woman who had been drinking at party drove to McDonald's where police were having a meal

McDonald's staff alerted police when motorist Lekeisha Marshall arrived at a drive-thru.

They feared that she had been drinking, and officers were already at the Bulwell premises having a meal, a court heard.

She failed a breath test at the restaurant, and later refused to give another sample for analysis at the police station.

That added up to a 40-month driving ban for Marshall, 28, who must also do 80 hours unpaid work.

She admitted failing to give a sample when suspected of drink driving on November 2.

Sanjay Jerath, prosecuting, told Nottingham magistrates that the police officers smelled alcohol on her and gave her a test.

This came up with a reading of 82, while the legal limit is 35. She was arrested and asked to take another test.

Mr Jerath added: "At the police station, she was rude and argumentative and was repeatedly asked to provide a sample."

Helen Nicholson, mitigating, said that Marshall had been at a party in memory of a friend who died ten years ago.

She told the court: "It was only a very short way from McDonald's but she accepts it was a very silly decision. She is extremely remorseful."

A probation report said that Marshall had "a couple of glasses of wine over a period of time. She doesn't like alcohol but was with friends.

"She went to McDonald's to get some food and accepts it was a stupid decision to drive. She should have got a taxi or a takeaway."

Magistrate Kim Geering told Marshall: "This was a deliberate refusal not to give a sample."

Jobless Marshall of Church Street, Ilkeston, must pay £175 costs. She had a drink drive conviction from 2012, leaving her liable to a ban of at least three years.

If she completes a course on the risks of drink driving, her latest disqualification will be reduced by 43 weeks.
