Woman in court after neighbours complain about cockerels waking them at 4am

A woman who keeps hens and cockerels is being taken to court after neighbours complained about being woken by crowing at 4am.

Jess Marson, 33, also keeps geese, goats and a pot-bellied pedigree pig called Brian on her small-holding in a semi-rural area.

Council officers have investigated the complaint and served Ms Marson with a noise abatement order.

She faces a day at Kirklees Magistrates' Court next month, reports Yorkshirelive.

In a witness statement to be put before the court next month one resident said: "The noise from the crowing cockerels has affected and continues to affect our daily life.

"This is not just a single bird crowing occasionally, with multiple birds being kept.

"Typically, once one starts other birds join in with almost continual crowing either simultaneously or consecutively.

"Depending on the season and weather we have had our sleep disturbed often as early as 4am or earlier, every day of the week including weekends.

"In addition, frequently the crowing would continue into the late evening.

"With such disturbance to our health has been affected as well as disturbing and spoiling any enjoyment we might have in being outside in our garden.

"More so in summer when doors and windows are typically open the noise also infiltrates the house.

"Almost three years ago, early 2019, we started to be woken up in the early morning by the sound of cockerels crowing.

"As this carried on we discovered the birds were housed a short distance away.

"The birds are in a direct line to, and almost at the same height as our bedroom window, around 120m away.

"Over time the number of birds kept has been increased exacerbating the issue. We believe that at least six cockerels have been kept and possibly 10 or more since 2019.

"It is almost three years since the problem started and our first complaint was made to Kirklees Council in 2019."

Jess said: "I love these cockerels. I don't have children so these animals are like my 'babies'.

"Obviously, it is not nice when you are being woken up but this is a semi-rural area and I rent the land from a local farmer.

"I was mad when I found out there had been a complaint. I would have liked the person concerned to have come to me personally instead of complaining via the council.

"I have had anti-crow collars fitted to the cockerels' throats which tighten their passages and dull the sound and I think that has made a difference. I think that is cruel."

She has now set up a gofundme page outlining her plight and asking for people to help her raise hundreds of pounds so she can be defended by a solicitor in court.

In it, she pleads: "I myself suffer from anxiety, of which keeping my chickens, (and a few other animals), help massively with this.

"I don't have children, they are my world. I love each and every one of my babies! I would be heartbroken if they were made to be removed.

"Please help me with my fight to keep my boys!"

Kirklees Council has been approached for comment.
