Partygoers threatened to 'kneecap dad with a shotty' while his kids slept

A woman got fellow partygoers to threaten to "kneecap" a man 'probably with a shotty'.

Chloe O'Brien was drunk at a party when she called a man who had allegedly sexually assaulted someone she knows.

Her friends threatened to storm his home as his children slept telling him "watch your back because a nine might go through your kneecaps".

The 20-year-old appeared at Liverpool Crown Court this morning for the "toxic" and "terrifying" threats to the man, who the ECHO has chosen not to name.

Chris Hopkins, prosecuting, explained O'Brien made a series of calls to the man, who recorded them on his phone, in the early hours of October last year.

In the call one male said: "I'm 10 minutes away from putting a party popper through your f***ing door with your children in there.

"I know you have a gun licence that's great cos I have.

"I'll [put a] f***ing gun through your f***ing kneecaps dirty little peado.

"One way or another I'm going to kneecap you with a ring hammer or probably a shotty."

O'Brien can then be heard over the phone shouting: "What have I told yer."

Another male said: "I'll send through your house while your children are in bed with your new little puppy asleep.

"You know when you're shooting in Tarleton on Sunday just watch your back because a nine might go through your kneecaps."

O'Brien is of former good character.

Adam Watkins, defending, said O'Brien is a young woman who has never been before the courts before and she "doesn't seek to justify her own behaviour".

He said there was a "particular context which helps to explain" but which "doesn't justify what she did".

Mr Watkins said the allegation is "still before the Spanish courts" and is "being treated seriously".

He explained the allegation had been "dealt with in the right way" by a report to police.

Mr Watkins said police had "told him not to have further contact" with the woman, but added "there was further contact" .

The court heard the alleged victim of a sexual assault later said the man had tried to "buy her off" and that "when she had resisted being bought off she had been followed".

When O'Brien was drunk at a party she started to tell others about the allegations, prompting her to make the calls to her victim.

He said: "This defendant is at a party and explained the difficulties she was having to others and no doubt there was an element of egging on."

Mr Watkins urged the judge to impose a community order and said a character reference talked of a "very different Chloe O'Brien".

O'Brien, of Prince Charles Gardens, Birkdale, admitted one count of sending malicious communications.

The judge, Recorder Ian Harris, said the messages are "toxic and terrifying".

He said: "The effect on the victims must have been shuddering."

Recorder Harris said the offence crosses the custody threshold and said "I don't know what message would be sent out if there wasn't a prison sentence".

The judge said he was able to suspend the custodial sentence due to her former good character and guilty plea.

Recorder Harris said: "There is an explanation for your behaviour but absolutely no excuse."

The judge said she "acted on completely unfounded allegations".

Recorder Harris said: "If you had taken a step back and thought about it there are other ways this could have been dealt with.

"Effectively you took the law into your own hands by these threats."

O'Brien was handed a six month sentence suspended for 18 months and must complete 15 Rehabilitation Activity Requirement days.

As he sentenced her the judge said: "In my judgement the sentence marks the seriousness of the offence."
