Terms and conditions
1. The Win a Masterclass every month for a year 2015 competition (the “Prize Draw”) is open to residents of the UK aged 18 and over.
2. The Prize Draw is not open to employees or agencies of Guardian News & Media Limited (“GNM”, the “Promoter” or “We”), their group companies or family members, or anyone else connected with the Prize Draw.
3. Entry into the Prize Draw is deemed as acceptance of these Terms and Conditions.
4. To enter the Prize Draw you must complete all fields of the online form above and submit your entry. If you have any questions about how to enter or otherwise in connection with the Prize Draw, please e-mail us at masterclasses@theguardian.com with “Win a Masterclass every month for a year” in the subject line.
5. Only one entry per person. Entries on behalf of another person will not be accepted. Joint submissions are not allowed. You are responsible for the cost (if any) of sending your Prize Draw entry to us.
6. No responsibility is taken for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason. Proof of delivery of the entry is not proof of receipt.
7. The Prize Draw closes at 23:59 on 31st January 2015. Entries received after that date and time will not be considered.
8. One winner will be randomly selected from all eligible entries.
9. The winner will receive a place in a Masterclass in each calendar month of 2015 (commencing March 2015 and ending 28th February 2016), such Masterclass being up to a maximum value of £500. This value cannot be used as a credit against more expensive Masterclasses. The winner can choose which course he or she attends, subject to its value and to availability at the time of booking. The winner can book and attend only one Masterclass per month and if he or she cannot use or does not book a Masterclass in a particular month, the place cannot be transferred to another month or redeemed for cash. Once a Masterclass is booked, it is non-cancellable and cannot be exchanged for a class on another date (even in the same month). The winner must book the classes with GNM directly using the telephone number provided by GNM (and there is no requirement to book all Masterclasses at once). The prize must be completed by 28 February 2016.
10. The winner will be notified by email or telephone on or before Friday 6th February 2016 and given details of how to claim their prize. Due to the time limited nature of the prize, if a winner does not respond within 3 days of being notified, then the winner’s prize will be forfeited and another winner will be selected in accordance with these Terms and Conditions (and that winner will have to respond within 3 days or else they will also forfeit their prize). If a winner rejects their prize, then the winner’s prize will be forfeited and GNM shall be entitled to select another winner.
11. The prize is non-exchangeable, non-transferable, and is not redeemable for cash or other prizes.
12. GNM retains the right to substitute the prize with another prize of similar value in the event the original prize offered is not available.
13. The name and county of the winner can be obtained after Friday 6th February 2015 by sending a stamped addressed envelope to the following address: Guardian Masterclasses, Guardian News & Media Limited, Kings Place, 90 York Way, London N1 9GU. The winner may be required for promotional activity related to the Prize Draw and each winner shall participate in such activity on the Promoter’s reasonable request.
14. GNM shall use and take care of any personal information you supply to it as described in its privacy policy, a copy of which can be seen at http://www.theguardian.com/help/privacy-policy, and in accordance with data protection legislation. By entering the Prize Draw, you agree to the collection, retention, use and distribution of your personal information in order to process and contact you about your Prize Draw entry, and for the purposes outlined in paragraph 13 above.
15. No purchase necessary.
16. Nothing in these terms and conditions shall exclude the liability of GNM under law for fraud or fraudulent misrepresentation, or for death or personal injury as a result of its negligence.
17. GNM accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering the Prize Draw or accepting the prize. GNM further disclaims liability for any injury or damage to your or any other person’s computer relating to or resulting from participation in or downloading any materials in connection with the Prize Draw.
18. GNM reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Prize Draw with or without prior notice due to reasons outside its control (including, without limitation, in the case of anticipated, suspected or actual fraud). The decision of GNM in all matters under its control is final and binding and no correspondence will be entered into. GNM reserves the right to discount votes if it suspects fraudulent bulk voting or multiple voting is taking or has taken place to inappropriately influence or manipulate the voting procedures.
19. GNM shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.
20. The Prize Draw and these terms and conditions will be governed by English law and will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
