Brian King Joseph, the man who accused Will Smith of sexual harassment, alluded to the pending allegations with a cryptic social media post shared days before going public with the lawsuit.
Joseph — a violinist and America’s Got Talent finalist who toured with Smith — this week filed a lawsuit against Smith alleging the actor was responsible for a “series of traumatic events” that took place during Smith’s global tour in 2025.

One week before the lawsuit was publicised, Joseph took to social media to urge followers to “speak out” against sexual misconduct in the workplace.
“Earlier this year, I was hired to be a performer on a major, major tour with somebody who was huge in the industry,” Joseph said in an Instagram video in December 2025.
“So I was excited, you know, proud of myself for getting the opportunity. Unfortunately, some things happened,” the musician claimed.

Joseph stopped short of delving too deeply into the claims — saying the situation was “already a legal issue” — but went on to speak broadly about “stand[ing] up for your beliefs and what is right no matter what”.
“I’m speaking out about this because getting fired or getting blamed or shamed or threatened or anything like that simply for reporting sexual misconduct or safety threats at work is not okay,” Joseph said.
The message came before news broke of Joseph’s lawsuit, which was filed in Los Angeles late last month and accuses Smith of “predatory behaviour” and “deliberately grooming and priming Joseph for further sexual exploitation,” according to documents obtained by Us Weekly.
The alleged incidents took place during Smith’s Based on a True Story World Tour, in which Joseph served as a supporting musician. The tour began in March 2025 in Las Vegas, where Joseph alleged he was the victim of someone “unlawfully” entering his hotel room.

The lawsuit claims Joseph returned to the hotel room to allegedly find wipes, a beer bottle, and a bottle of HIV medication with another individual’s name, as well as a note addressed to him.
“Brian, I’ll be back no later [sic] 5:30, just us, Stone F,” the note allegedly read alongside a drawn heart symbol. According to the lawsuit, Joseph believed the note indicated that “an unknown individual would soon return to his room to engage in sexual acts”.
Elsewhere in the filing, Joseph alleged that the management team of Smith’s tour accused him of lying and later terminated his employment when he reported the hotel room incident.
Smith has denied the allegations as “false, baseless and reckless” via his attorney Allen Grodsky.
“[The claims] are categorically denied, and we will use all legal means available to address these claims and to ensure that the truth is brought to light,” Grodsky said in a statement to Page Six.

Released in March 2025, Based on a True Story marked Smith’s first album in more than two decades, and featured the singles “You Can Make It,” “Work of Art” and “Tantrum”.
