Why Katie Price wasn't jailed over drink-drive crash - legal loophole keeps star free

Katie Price has been lucky enough to avoid jail-time in her drink driving case thanks to a legal loophole, which a district judge made clear.

The ex glamour model was given a suspended sentence at Crawley Magistrates' Court on Wednesday, despite admitting previously she could have killed someone after getting behind the wheel under the influence causing the September car crash.

District Judge Amanda Kelly sentenced Katie to a 16-week prison sentence, suspended for 12 months and told the mum-of-five she's very lucky not to be spending Christmas in jail.

Katie will also have to undergo 100 hours of unpaid work in the community while her driving ban has been kept to two years, and she will not have to take an extended driving test.

There will be no separate penalty for the charge of driving without insurance.

Explaining her decision, the judge told Katie she was unable to send her to prison because of a previous decision at her plea hearing.

At that hearing, a magistrate agreed to defer Katie's sentencing to today on the understanding she attended rehab facility The Priory for treatment and didn't commit any further offences.

And because those criteria were met, the judge explained she couldn't send her to jail.

She said Katie was "extremely lucky" the magistrate chose to defer her sentence.

District Judge Kelly told Katie she was lucky that she wasn't going to prison, but that her hands were tied on the matter.

She told the reality star: "You deserve to spend Christmas behind bars."

The court also heard Katie had been banned from driving five times previously.

The judge said Katie's driving record was "one of the worst" she had seen.

She said: "You showed no concern for the lives of others, you could have easily killed somebody.

"Unlike you not everyone has the luxury of putting themselves into the Priory clinic when their lives get hard."

She said her driving record was "absolutely appalling" and her actions were "incredibly selfish".

Katie was also ordered to pay £213 in costs, with the hearing told she already owes the court £7,358.
