Adnan Syed - is he still in prison? Details as HBO picks up Serial case

Millions of people from around the world have been following the life of Adnan Syed for years.

Even two decades after the death of his ex-girlfriend Hae Min Lee, Syed –  whose case is documented in popular podcast Serial and HBO's new four-part series – is adamant that he had nothing to do with the her killing.

However, the courts believe differently, and he has recently been denied a new trial despite significant public outcry.

Why was Adnan arrested and jailed?

Adnan Syed was sentenced to life in prison plus 30 years in February 2000, after being convicted of first degree murder, robbery, kidnap and false inprisonment.

The sentence came a year after his ex-girlfriend and school-mate Hae Min Lee was discovered buried in Baltimore park, aged just 17, having died of manual strangulation.

Police were said to have received an anonymous call suggesting that Syed was to blame for her murder.

In court, the prosecution claimed that Syed, then 18, had murdered his ex out of jealousy after she broke off their relationship – something he has always denied.

Is Adnan still in prison?

Syed's case has gained a huge amount of attention due to the success of podcast Serial, and HBO series, The Case Against Adnan Syed.

However, despite pleas from many members of the public who believe he is innocent, he is still currently behind bars.

Recent attempts for a new trial were overturned by The Court Of Appeals last month.

While the court recently found that he had received ineffective legal counsel during his original trial, leading to fresh hope he may be released, four judges against three from the Maryland Court of Appeals then ruled out their findings.

They are said to have agreed that his lawyers were deficient in investigating one of their alibi witnesses, but argued that this didn't damage his case enough to merit a new trial.

This isn't Syed's first unsuccessful attempt to appeal his case, as he also tried in 2003 and 2010, to no avail.

What was the evidence against Adnan and why do some believe he is innocent?

One of the main reasons the prosecution deemed Syed a suspect was because of his phone records.

These led to two witnesses, Jay Wilds and Jennifer Pusateri, who eventually gave statements which aided his conviction.

Pusateri informed police that Wilds had been using Syed's phone to call her, while Wilds eventually placed himself with Syed as he claimed he'd helped him bury Hae Min Lee's body in Leakin Park.

However, after his conviction, Syed's lawyer insisted in 2015 that the cell data was unreliable, as AT&T warned themselves that outgoing call information wasn't accurate enough to be admissible in the courtroom.

 

They added that Syed's original lawyers failed to call witness Asia McClain to the stand, who claims to have seen him in the library at the time of the murder.

Syed's attorney Justin Brown claimed that he was "devastated" when he found out he wasn't getting a re-trial.

He told the Baltimore Sun: "There was a credible alibi witness who was with Adnan at the precise time of the murder, and now the Court of Appeals has said that witness would not have affected the outcome of the proceeding.

"We think just the opposite is true. From the perspective of the defendant, there is no stronger evidence than an alibi witness."
