West Lothian Council investigate developers accused of breaking planning rules over wildlife

West Lothian Council is launching an investigation after it was alleged developers were intruding on birds nesting.

A concerned resident contacted The Courier after spotting works taking place in wet land in the middle of nesting season.

West Lothian Council say all developers must abide by wildlife rules and the planning department is looking into the allegation at Heartlands in Whitburn.

A spokesperson said: “All developers have to ensure they are working under the terms of the Wildlife & Countryside Act, to ensure they protect wildlife and the environment. This is a legal requirement, separate from any planning conditions.

“The matter will also be investigated by the planning department.”

The anonymous resident contacted The Courier last week after visiting the site.

They said: “Digging is going on in this wet land area.

“Birds are now right in the middle of the nesting season.

“This area is where lapwing nest every year as well as other birds. Some come to nest, visit, stay all year round.

“What a sight to see for my town, this shows zero interest or care in our birds and wildlife.

“If planning has been given then there should have been clear instructions not to touch land during nesting season.”
