'Vigilante' men found not guilty of trying to break into home of child sex offender

Three men accused of trying to break into the home of a child sex offender in February have been found not guilty.

Joshua Darcy Watson, Paul Arthur Palmer and Daniel James Nicholas were arrested at the Page home after a man called triple-0 saying he feared for his life.

The three men, aged in their 30s, were charged with attempting to break into the home of 62-year-old Sunil Batagoda with the intention of causing him harm or threatening to cause him harm.

The visit was prompted by concerns about a lewd video of Batagoda with a 14-year-old girl.

Batagoda is in jail after pleading guilty to offences against four girls.

Prosecutor Rebecca Christiansen told the jury the men had been frustrated because they believed police had done nothing about Batagoda even after they had been given the video.

She told the jury there had been nothing innocent in the visit.

"It was not to stop by to borrow a cup of sugar," she said.

She said Batagoda may have been a sex offender, but vigilante justice should not be tolerated.

Part of the evidence alleged against the men was that one had a knife, there was some wire and a piece of pipe.

It was alleged these were tools to help them break into the home.

But lawyers for the men told the court if they were serious about breaking in they would have used other tools from their car, including a tyre lever.

The court heard there was no evidence of any conspiracy between the men to break in, and they had only gone there to talk to him, and show him the video.

Lawyer for Mr Nicholas, Alyn Doig, told the jury, "they were there to do what they told the police".

The jury took a day-and-a-half to find each of the men not guilty.
