Vic man abused sister's sick teen friend

A Victorian man who attempted to rape his sister's teenage friend while she was vomiting in a toilet has been spared an immediate jail term.

A jury found the man, 47, guilty of attempting to rape the 13-year-old girl while she was throwing up after a drinking session at the man's Frankston home in 1994.

He was handed a two-year suspended jail term in Victoria's County Court, meaning he can live in the community for the duration of the sentence if he does not commit further offences.

Judge Scott Johns said the man, then 20, was the only adult in the house as he and sister's parents were out.

"Trying to violate anyone, let alone such a vulnerable 13-year-old girl, is reprehensible," Judge Johns told the court.

"She was, and continues to be, deeply traumatised by your offending."

The woman, who cannot be named, said she reported the incident to police in 2016 after carrying the trauma through her formative years.

She said the attempted rape led her to drop out of high school before experiencing suicidal thoughts, eating disorders, depression and night terrors.

"I felt so ashamed, traumatised, dirty and detached from life," she said in a statement.
