Boris Johnson's lawyer has argued the suspension of Parliament is "the territory of political judgements not legal standards," during the second day of hearing's at the Supreme Court.
The UK's highest court is considering whether the Prime Ministers advice to the Queen to prorogue Parliament was lawful.
Lawyers representing Mr Johnson have argued that his advice was lawful and that, in any event, the court cannot interfere in political matters.
Mr Johnson has said the five-week suspension is to allow the Government to set out a new legislative agenda in a Queen's Speech when MPs return to Parliament on October 14.
