Two smokers forced to cough up more than £350 each after littering

Two women have ended up more than £350 lighter after failing to pay fines for dropping cigarette ends in the street.

Fixed penalty notices were issued to each woman following two separate incidents in Ilkeston where they were seen littering.

Billie Mae Cross, 23, of Godfrey Drive, Kirk Hallam was found guilty of littering after she was seen dropping a cigarette end on a street in Ilkeston by one of Erewash Borough Council’s neighbourhood wardens.

She was issued with a fixed penalty notice but failed to pay it.

In a separate incident, Sarah Clements, 32, of Coppice Avenue, Ilkeston was also found guilty of littering for dropping a cigarette end.

She was also issued with a fixed penalty notice by a neighbourhood warden which she too failed to pay.

As a result, both women appeared at Southern Derbyshire Magistrates’ Court and were fined £220 each, made to pay a £30 victim surcharge and the council’s full costs of £127.50. A total of £377.50 each.

Both offences happened in December 2018, with the cases heard in court on Wednesday, July 31 under the single justice procedure.

Littering is a crime under section 87 the Environmental Protection Act 1990. 

Councillor Garry Hickton, Lead Member for Environment at Erewash Borough Council, said: “Smoking is an expensive habit, even more so for those who choose to litter the streets of Erewash with cigarette ends.

"These latest cases show that the council will not tolerate our borough’s streets being littered with rubbish.

"Hopefully these hefty fines will act as a deterrent to anyone who is thinking of discarding their cigarette ends in this way.”
