Married daughters eligible for die-in-harness benefit: Tripura HC

AGARTALA: The High Court of Tripura dismissed five writ petitions of the state government challenging the eligibility of married daughters in availing the die-in-harness benefit in case of a parent’s death.

A division bench of High Court comprising Chief Justice Indrajit Mahanty and Justice S G Chattopadhyay upheld the judgment passed by the former Chief Justice Akil Kureshi ruling that married daughters, who are economically dependent on the deceased parent, could be considered as an eligible candidate under the die-in-harness scheme.

After the hearing, the High Court disposed of the five writ appeals of the Tripura government, which had challenged the previous order. The advocate of the respondents, P Roybarman, pointed out that the judgment stands significant as it does not give financial relief to married women, but empower them economically.

The court also rejected the discrimination being meted out against married daughters on the basis of their gender and social norm. It also set certain parameters for eligibility criteria, including the claimant must be financially dependent on the deceased parent.
