Train conductor cleared of endangering passenger who fell on tracks

A train conductor has been acquitted of endangering a passenger's safety after a man fell in a gap between a train and a platform.

Nigel Lawless, 56, was accused of failing to see passenger Gavin Davies who had fallen onto the track at Radyr railway station in Cardiff on July 25, 2019, before signalling for the train to pull off.

Mr Davies, who had been out drinking in Cardiff city centre on a retirement do, was stuck between train and the platform as it began to leave the station but a quick-thinking woman who had just left the train alerted the driver.

Mr Davies sustained minor bruising and back and stomach pain but no serious injuries.

The defendant, of Ynyswen Road, Ynyswen, Rhondda, denied responsibility for the incident and pleaded not guilty to a charge of endangering safety of person conveyed by railway by wilful omission or neglect.

Mr Lawless, who has 20 years of experience on the railways, admitted to police he had not seen or been made aware Mr Davies had fallen onto the tracks but he maintained he had carried out his responsibilities and duties correctly.

A trial began at Cardiff Crown Court on Monday and the jury returned a not guilty verdict on Thursday.

Recorder Paul Lewis told Mr Lawless he was free to leave the court and brought an end to proceedings.
