The Supreme Administrative Court has upheld a lower court ruling awarding Northern Bangkok Expressway Company Limited (NECL) 1.8 billion baht in compensation for losses from unwarranted competition.
The court's decision yesterday was reached in favour of the Central Administrative Court ruling which sided with the result of an arbitration panel called to mediate in the dispute between NECL and the Expressway Authority of Thailand (Exat).
NECL argued that the Don Muang tollway's National Memorial-Rangsit section, overseen by Exat, is in direct competition with the nearby Bang Pa-in-Pak Kret expressway, which it was contracted to build and run.
NECL's contract included a provision that it would not face direct competition and it alleged that the tollway had caused the firm to lose revenue to the tune of 1.8 billion baht.
The arbitration panel ruled in NECL's favour and the case was referred to the Central Administrative Court which ordered Exat to pay compensation.
Exat had appealed the ruling which was upheld by the Supreme Administrative Court yesterday.
