Thug who spat on cop and tried to bottle another after crashing car faces jail

A teen bigot who spat in a police officer's face and tried to hit another cop with a bottle was warned today that he could be tagged or jailed.

The 17-year-old, who cannot be named for legal reasons, was arrested after crashing a Fiat Punto into a garden fence and into another car and then failing to stop.

The incident occurred in Slamannan, Stirlingshire, on October 25th 2020.

At Falkirk Sheriff Court, the youth pleaded guilty on indictment to the motoring offence, and to assaulting PC David MacDonald by spitting in his face and assaulting the other officer, PC Andrew Davidson, in the course of his duty, by attempting to strike him on the head the the glass bottle.

He also admitted assaulting a police civilian employee by kicking him on the body at Falkirk Police Station, and committing a statutory breach of the peace by brandishing the bottle and challenging police to fight, repeatedly spitting in the rear cell of a police van, and uttering offensive remarks and threats of violence towards police officers and of sexual violence to their families.

He admitted that breach of the peace was aggravated by prejudice regarding sexual orientation.

Solicitor Robert Smith, defending, said: "He is a 17-year-old boy with no previous convictions."

Sentence was deferred until March 16th for the full facts of the case to be narrated by the prosecution, and for social workers to prepare background reports on the youth, including a tagging order assessment.

Sheriff Christopher Shead told him: "The court is prepared, given your age, and notwithstanding the charges, to continue your bail meantime.

"Obviously the court will have to consider a sentence of detention.

"Whether that's inevitable or not is a completely different question, and will be subject to detailed consideration on the next occasion."
