Thug who robbed neighbour and threatened to rape cops' 'weans' avoids jail

A Hamilton man who attacked a householder and fled with a gas mask has been put under social work supervision.

Andrew Murphy had been held in custody since the attack on his victim in Burnbank Gardens, Hamilton, on March 3.

Murphy, 30, a prisoner, appeared for sentence at Hamilton Sheriff Court this week.

He admitted assault and robbery, and making vile comments and threats to police officers after his arrest.

Mairi-Clare McMillan, prosecuting, said the victim was drinking alone in his home around 10pm when he heard what he believed to be a neighbour's voice outside.

She told the court: "He opened the door and was dragged backwards by the neck of his t-shirt into the living room.

"He recognised the accused who was behaving aggressively, but was also distressed and crying.

"Words were exchanged and the victim was struck on the head.

"The accused said 'I'm f***ing having this', referring to a black gas mask that was on display in the living room.

"Murphy then went into the kitchen, grabbed a knife and left the house."

The victim suffered a small cut to his head.

Murphy was traced two hours later. He was still carrying the mask, but didn't have the knife.

He had sustained an injury and was taken to hospital where he hurled homophobic abuse at police officers.

He also warned them: "I'll rape your weans."

Defence agent Jackson Bateman said Murphy had been having difficulties with his partner.

He was distressed after taking alcohol, Valium "and other substances", and couldn't remember much about the robbery.

As an alternative to more jail time, Sheriff Thomas Millar placed Murphy under supervision for 18 months.
