A terminally ill dad wants Parliament to change the law as figures revealed one Briton a week travels to Switzerland for an assisted death.
Motor neurone disease sufferer Phil Newby had a bid for a High Court judicial review turned down and has lost his appeal.
Phil, 49, of Rutland, said: “Judges will not engage on the issue – it is down to Parliament to act.”
Zurich clinic Dignitas said 42 Britons went to die there last year.
A further 11 had assisted deaths at Life Circle in Basel.
MPs rejected a law change on right-to-die by 330 votes to 118 in 2015.
But after a Westminster debate last week, Justice Secretary Robert Buckland said he would “actively consider” a call for evidence on the UK ban.
Sarah Wootton, of campaign group Dignity in Dying, called the court’s decision “disappointing”.
She added: “Banning assisted dying drives the practice overseas.”
Care Not Killing chief Dr Gordon Macdonald called the case an attempt to “introduce assisted suicide via the back door”.
