Teacher banned from the road after admitting drink drive offence

A teacher who became upset with a policeman's manners has been banned from the road for drink driving.

Richard Shipman, 38, did not like the officer's attitude and left one leg out of the patrol car when detained, Nottingham magistrates heard.

He questioned the procedure but remained silent when asked for his details, said Ben Payne, prosecuting.

When told to give a breath test, Shipman replied: "What if I say no?"

He tried to use his mobile phone but was told this was not allowed when under arrest.

Mr Payne went on: "He tensed his arms when the officer went to put cuffs on him."

At the police station he used an abusive word and said he was "not listening," added Mr Payne.

Katherine Macmillan, mitigating, said he regretted the incident but was upset by the officer.

"Mr Shipman has a long history as a teacher over many years and has always treated people with a certain level of respect and courtesy.

"He found the police officer was unnecessarily loud and aggressive in his dealings with Mr Shipman," she told the court.

A 20-month driving ban was imposed on Shipman, of Nethermere Lane, Nottingham. He admitted driving with 60 micrograms of alcohol in 100 millilitres of breath, 25 over the legal limit.

He also pleaded guilty to obstructing a police officer on the A610 at Eastwood on September 21.

He was fined £300 and must pay £85 prosecution costs and a £32 government surcharge. There was no penalty for obstruction.

The court heard he will have to give up voluntary work of taking out elderly people five times a week.

If Shipman completes a course on the perils of drink driving, the ban will be reduced by 22 weeks. He had never been in trouble before.
