Takeaway pints Dublin latest on whether you can buy drinks and consume them in public

As restrictions begin to lift for the first time in months, many are making plans for the expected improvement in the weather as we reach the middle of April.

With hope across Ireland that Summer 2021 will be one to enjoy there are many questions surrounding the reopening of outdoor dining and pubs.

Now two households can meet up outside (but no in their own garden) and businesses affected by the pandemic will be doing their upmost to please customers.

That brings takeaway pints back onto the menu with many already wondering where they can pick up a nice pint on a warm Spring day.

Taoiseach Micheal Martin warned earlier in the year that people should "forget about takeaway pints" but that was during Ireland's worst outbreak of COVID-19.

What's the law surrounding takeaway pints?

There is no official law that can stop businesses selling or the public consuming takeaway pints, once they're 100m away from the premises where the alcohol was bought.

A garda spokesman told Dublin Live: "The sale of take away alcohol from licensed premises is not currently a penal regulation and therefore not an offence.

"In respect of regulations, which are declared to be Penal Regulations under the Health Act 1947 as amended, An Garda Síochána continue to adopt the approach of the Four Es which see Gardaí engage, explain, encourage, and as a last resort, enforce."

What does the Government say?

A spokeswoman for the Department of Health previously told Dublin Live in February: “Under current Covid-19 restrictions, cafes, bars, restaurants, and pubs may only sell food or drink, including intoxicating liquor, for takeaway. This is set out in SI 701 of 2020.”

Be careful...

Gardai can act though on public order incidents if they arise among people drinking takeaway alcohol and they can act on other breaches such as mass gatherings among those who have bought takeaway alcohol.
