Supreme Court nixes plea challenging DY Chandrachud appointment as CJI

NEW DELHI: The Supreme Court on Wednesday dismissed a petition challenging the appointment of Justice DY Chandrachud as the next Chief Justice of India and to restrain him from taking oath of office on November 9 and termed it “completely misconceived”.

As the petition was mentioned for an urgent hearing, a bench of CJI UU Lalit, Justices S Ravindra Bhat and Bela M Trivedi agreed to hear the case 15 minutes before lunch break and dismissed it after a brief hearing.

“Having heard the learned counsel for the petitioner, we see no reason to entertain the petition. In our considered view, the entire petition is completely misconceived and therefore dismissed,” the bench said.

The petitioner alleged that Justice Chandrachud had heard and passed an order in a case in which his son had appeared as a lawyer in the HC. It was contended that the judge should have recused from hearing. The bench then asked the petitioner to show that the HC order containing name of the son was attached with the appeal filed in SC.
