Supreme Court Case Could Reduce Charges For Capitol Attackers

Supreme Court The first day of the court's new term in Washington

Arguments are currently being heard at the Supreme Court in the case of Fischer v. US, a pivotal case that could potentially lead to a reduction in criminal charges for over 350 individuals involved in the attack on the US Capitol on January 6, 2021.

The central issue in question pertains to a charge brought forth by prosecutors in numerous cases, which prohibits individuals from 'obstructing' an 'official proceeding.'

This case holds significant implications not only for the aforementioned defendants but also for former President Donald Trump, who faces the same charge in special counsel Jack Smith's election subversion case.

Jeffrey Green, representing a former Pennsylvania police officer implicated in the Capitol attack, is the first to present arguments. Green contends that the law in question was originally designed to address instances of evidence tampering rather than acts of rioting.
