Student who stabbed classmate found not guilty due to mental incompetence

A student who stabbed a classmate at Renmark High School in South Australia's Riverland has been found not guilty on the grounds of mental incompetence.

Amber Brea Rover, 19, of Paringa, was charged with aggravated causing serious harm after she allegedly stabbed a 17-year-old girl last July.

The court heard a psychiatric report found Ms Rover suffered from the psychiatric illness of schizophrenia and was psychotic at the time of her offending.

The court heard there was "no real contention between the two parties", with both defence and prosecution accepting the content of the report.

Judge Jo-Anne Deuter said the report also found Ms Rover "was unable to control her conduct and could not understand that her actions were wrong".

"Therefore, he concludes that she was not mentally competent to commit the offence," she said.

"In those circumstances and on the basis of that report … I find the defendant mentally incompetent to commit the offence."

The court previously heard both students had to be airlifted to the Royal Adelaide Hospital and that the victim suffered a punctured lung from the life-threatening stab wound.

The court heard Ms Rover would likely apply for "some sort of release for lessening her current status, which is full-time detention".

Judge Deuter ordered two psychiatric reports, which will determine Ms Rover's prognosis and ability to be released into the community.

She will be remanded at James Nash House until her next court appearance in July.
