One of the survivors of a horror fatal crash at Gateshead that claimed the life of a 13-year-old boy has been charged over an alleged aggravated break-and-enter police believe is linked to the incident.
Brodie Fitzpatrick, 18, was granted strict conditional bail in court this week, including a curfew and twice-weekly police reporting.
Police opposed bail, citing the seriousness of the alleged offending and an unacceptable risk to community safety.
The court heard Fitzpatrick had no prior adult convictions but had a significant history of mental health issues.
About 2.30am on Monday, August 3, police allege two men attempted to break into a parked car and a home on Paterson Close at Whitebridge.
The men then allegedly left the scene in a Toyota Kluger.
A short time later, that car crashed into a paddock. A teenage boy died and a 14-year-old boy was taken to hospital with leg injuries.
Friends of the 13-year-old boy have remembered him with a tribute of flowers and some of his favourite things at the scene.
About 6am on Monday, Fitzpatrick and a 15-year-old boy were arrested on Willow Road at Gateshead.
The pair were taken to John Hunter Hospital under police guard.
On Tuesday afternoon, Fitzpatrick was discharged from hospital and taken to Waratah Police Station.
He was charged with attempted aggravated break-and-enter in company with the intention to steal.
As part of his bail conditions, Fitzpatrick is not to contact anyone else involved in the crash.
Inquiries are continuing, and Fitzpatrick will face Belmont Local Court again on August 12.
