Southern Minnesota homeowner charged in home invasion shooting death

MINNEAPOLIS _ A southern Minnesota homeowner was charged Monday in a home invasion incident that left one man dead and another wounded.

David A. Petterson, who lives southeast of Madelia, was charged in Watonwan County District Court with second-degree manslaughter and intentional discharge of firearm in connection with the death of Nicholas T. Embertson, 19, of Madelia.

The incident unfolded about 7 a.m. Saturday at Petterson's residence in Fieldon Township, according to the Watonwan County Sheriff's Office.

Petterson, 65, appeared in court Monday morning and remains jailed. His bail was set at $100,000.

The identity of the other man who suffered noncritical wounds has yet to be released. Chief Sheriff's Deputy Jeremy Nachreiner declined to say whether that person was hit by gunfire or wounded some other way.

While the law allows for the "justified taking of a life if your life or your family's life is in danger," Nachreiner said Monday, "what we gathered from evidence and statements was that (manslaughter) was the appropriate crime."

A deputy driving to the scene of a reported shooting stopped a car believed connected to the incident, according to the Sheriff's Office.

Two people with wounds were in the vehicle, the Sheriff's Office added. An ambulance was called, and the two were hospitalized in Madelia. Embertson died at the hospital.

Deputies arrived at the house and spoke with Petterson. Nachreiner said the homeowner offered no resistance during his arrest.

The chief deputy said this was his agency's first contact with Petterson.

The ranch-style home, built in 2004, is described on the county's property records as being valued at $425,000. It has more than 3,200 square feet of living space, with four bedrooms, 3 { bathrooms, two patios and a deck.
