Smirking sex offender mows down mum after caravan row

A convicted sex offender deliberately rode a bike into a Royal Navy officer after a row over his caravan.

Wirral mum-of-one Hayley Shakeshaft returned home from a tour to Syria only to become locked in a dispute with Kirk Eden.

He was staying in a caravan on the grounds of Barnston Towers Close in Heswall, where Miss Shakeshaft lives with her daughter.

Liverpool Crown Court heard there was a "longstanding issue" about whether 47-year-old Eden had a right to be living there.

And it turned to violence when he decided to crash his bike into Miss Shakeshaft, knocking the 36-year-old to the ground.

Miss Shakeshaft put out her hand to break her fall, but suffered a fractured wrist and bruising to her shoulder, hip and thigh.

Judge David Aubrey, QC, today told Eden: "Whilst she was in pain she noted that you were smirking at her before riding off."

The victim's wrist was in plaster for five weeks, she had to wear a splint for two months and even now she has a "dull ache" in her wrist when it is cold.

Miss Shakeshaft said she previously considered herself "a strong independent woman" but was left feeling "deflated" and didn't recognise herself now.

She told the court she was unable to join HMS Tamar that month as planned, was medically downgraded by the Navy and put on restricted duties.

And the young naval officer said such was the "massive impact" on her life that she even considered suicide.

Brian Treadwell, prosecuting, said Eden living in a caravan on the grounds of the private site had caused problems between him and Miss Shakeshaft.

He said: "There was a longstanding issue about whether he had the right to occupy this private property and he took to social media and had hundreds of posts about this matter."

When she returned on January 16 last year, an "issue arose" between them about the placement of bins.

Mr Treadwell said: "As it was not collection day, she returned them to where they were supposed to be located."

The court heard Eden then attacked Miss Shakeshaft with his bike, only to claim when arrested and interviewed that she had "blocked his path" and his front wheel had struck a bin, but fail to explain how she ended up on the ground.

Eden, now of Rocklee Gardens, Little Neston, denied inflicting grievous bodily harm, only to plead guilty to the charge a week before a trial in April this year.

The court heard he has 27 previous convictions for 84 offences, including seven sex offences, 25 theft and fraud matters, making threats to kill, assaults, harassment and breaching court orders.

Louise McCloskey, defending, said Eden's guilty plea "albeit late in the day" had prevented Miss Shakeshaft from having to go through "the trauma" of a trial.

She said a probation officer felt that most of her client's criminal offences were "underpinned" by his "substance misuse", which had lasted for almost 25 years.

However, she said over the last 20 months he had voluntarily engaged with drug services, become "drug free" and provided negative tests to prove this.

Ms McCloskey said the author of a pre-sentence report noted "difficulties" Eden had including his "entrenched views of either females or people who cause him difficulties in his day to day life".

The lawyer referred to past "traumatic incidents", which she said perhaps explained why Eden had turned to drugs, but said she wouldn't go into detail in open court, adding: "Clearly he's had a difficult life."

Ms McCloskey said Eden was a carer for his elderly father, whose medical conditions could "rapidly lead to his death", and who would suffer if he was sent to prison.

She asked the court to consider taking "an exceptional view" given Eden's "significant progress" and to spare him jail.

Judge Aubrey told Eden: "Many of the references that you have provided to this court make reference to your love of cycling. They make reference to the fact that you are passionate about cycling and you are described as a champion cyclist."

However, he said "no doubt on impulse and in part because of the background" between him and his victim, "you chose to use your beloved bicycle as a weapon".

The judge said: "You deliberately rode your bicycle coming around a corner at speed and rode into Miss Shakeshaft.

"That caused her to fall to the ground with some force."

Judge Aubrey said Miss Shakeshaft suffered "serious physical injuries" but also "very significant" psychological injuries because of Eden.

He said: "She has been unable to perform her full Naval role. That not only has resulted in hardship to her but also she has suffered a loss of earnings.

"In her victim personal statement that once strong, independent woman describes herself as suffering from huge mental anguish."

The judge said: "She does not think that she will ever be the same person again."

He added: "She had even contemplated taking her own life."

Judge Aubrey said the offence was aggravated by his record including assault causing actual bodily harm in 1993 and battery in 2007.

He jailed Eden for two years and three months, as Miss Shakeshaft sat crying in the public gallery while being comforted by her family.

Judge Aubrey also imposed a five-year restraining order to protect the victim.
