KOCHI: After the Kerala High Court granted interim bail to the convicts in Sr Abhaya case on Thursday, human rights activist Jomon Puthenpurackal - the convenor of Abhaya Action Council that played a major role in ensuring that the case reached its logical end -came out against the Central Bureau of Investigation (CBI).
Puthenpurackal alleged that CBI did not file a counter affidavit after the bail application was filed and the agency failed to explain the facts before the court. Puthenpurackal said that he will approach the Supreme Court against the high court order and file a complaint with the CBI director and the prime minister stating the 'lapses' on the part of the agency in the case.
"No one can be blamed if they doubt that CBI had a role in helping the convicts secure bail in the case after they were convicted by a CBI special court. It has been nearly one-and-a-half years since the convicts filed an appeal challenging the special court's verdict. The deputy SP, who is CBI's investigating officer, did not file a counter petition. Also, they brought an advocate from Telangana, who cannot converse in Malayalam and did not even study the merits of the case, to represent the agency. CBI's prosecutor failed to explain the facts correctly and answer the questions raised in court," Puthenpurackal said.
He also alleged that CBI did not show any interest in him meeting the prosecutor to discuss the case. The CBI prosecutor, who appeared for the agency in special court, too did not turn up to meet the new prosecutor. CBI's standing counsel post in the high court has been lying vacant for the past one year, he alleged.
Puthenpurackal has recently published his autobiography titled 'Daivathinte Swantham Vakkeel' (God's own advocate), in which Sr Abhaya case is the main topic.
