Sheriff spares dog but owner fined after it bit another dog and two people

A man whose dog attacked two people and another dog has been fined and ordered to keep the animal under strict control, writes Tara Fitzpatrick.

Gordon McCabe, of Glenapp Place, Kilwinning, appeared before Kilmarnock Sheriff Court last week where he admitted being in charge of a Staffordshire Bull Terrier on May 16 this year which was dangerously out of control.

McCabe’s dog, named Blue, was off a lead and unmuzzled when it ran onto a public footpath and lunged towards a collie dog, and bit the dog causing severe injury.

Blue also repeatedly bit a 71-year-old man and a woman to their severe injury and failed to desist when repeatedly instructed to.

McCabe, 42, was fined a total of £650 – which included a compensation order for the dog victim’s vet bill of £135.

Sheriff Jamieson refused the Crown’s motion for the destruction of the dog and for McCabe to be disqualified from owning animals.

He said: “Unless you or any other owner keeps him under control he will be destroyed.

“You must take proper measures to keep him under control.

“Blue will be muzzled and have no access to the front garden other than for walks.

“The front garden will be fitted with a gate of four feet and Blue will be kept on a lead no greater than six feet.”
