BENGALURU: The high court on Thursday granted permission to a Special Investigation Team (SIT) to submit a final investigation report/chargesheet in connection with the sex-for-job case allegedly involving former minister Ramesh Jarkiholi.
A division bench headed by chief justice Ritu Raj Awasthi passed this order while disposing of an interlocutory application filed by the SIT.
However, all the contentions raised by the complainant woman regarding the validity of SIT have been kept open.
“The question with respect to the constitution of SIT under the impugned orders and the validity of the said SIT is to be considered by this court,” the bench said in its order. “So far as permission to submit the investigation report is concerned, we are of the view that once the investigation is completed and it has been duly accepted and approved by the head of the SIT, there is no reason to restrain respondents from submitting it before the competent magistrate court concerned. ”
Earlier, GR Mohan, counsel for the petitioner in a PIL and senior advocate Indira Jaisingh, appearing for the woman, submitted that the SIT was not constituted by the state government or the court and the entire investigation was done without competence and jurisdiction. They argued that the “so called SIT” was constituted even prior to filing of the criminal case.
However, senior advocate Ashok Haranahalli, appearing on behalf of SIT, submitted that there is no infirmity or illegality in the investigation.
