Scots rape accused 'violated mum while she slept on couch' court hears

A mum of three told a jury that a rape accused “violated” her while she was asleep on a sofa.

The 51-year-old – who can’t be named for legal reasons – also claimed that Martin Dolan repeatedly raped her while she was in a relationship with him.

Dolan, 55, from Falkirk, Stirlingshire denies a total of 16 charges which include repeated rapes and physical and sexual assaults against five former partners, three of whom were pregnant when he allegedly attacked them.

He has lodged special defences claiming all of the complainers consented to sexual activity with him and were awake and capable of giving consent at the time. He has also claimed he was acting in self-defence during two of the alleged assaults.

The mum – giving evidence at the High Court in Livingston via a closed circuit TV link – said Dolan drank alcohol every day while she was with him despite money being tight.

She said he gave her a black eye on one occasion and on another brutally wakened her by punching or kicking her in the stomach as she slept on a beanbag in the hallway of a new flat they had moved into in Hallglen, Falkirk, in the late 1980s.

She told the jury: “Martin did work back and forwards, but not for a long period of time. He was in and out of quite a few different jobs.

"Joint benefits were paid in his name. I’d have to ask for money to top up the electric meter and things like that because I had no money at all.”

She said the abuse she suffered was mostly emotional but sometimes physical and sexual.

She said: “There was one night I’d fell asleep on the couch in the living room. It was in the evening. Martin was there.

“I was woken because I had the feeling of someone penetrating me."

She continued: "It was Martin. Martin was there. He was on the same sofa. Martin had used something to violate me.”

She said by the time she woke up the indecent assault was no longer happening. She added: “He denied that he had done it.”

Another of Dolan’s ex partners, a 55-year-old from Preston, Lancashire, gave evidence that while she was pregnant she had “ended up at the bottom of the stairs” after an altercation with the accused.

She said: “I can’t remember if he pushed me on purpose or got angry." She says she then decided to leave him.
