Scots mum claims she woke up to discover man between her legs sexually attacking her

A mum has told a court she was sexually assaulted as she slept.

The mum-of-two said she was woken up in the middle of the night to find accused John Jeffery performing a sex act on her.

She said the attack took place in a bedroom, while her brother was sleeping on the couch in the living room.

The details emerged as the 30-year-old gave evidence at Jeffery's Paisley Sheriff Court trial on Wednesday.

Jeffery, 35, denies sexually assaulting the woman, who can't be named for legal reasons, by removing her clothes and performing a sex act on her.

Prosecutors claim he broke Section 2 and 3 of the Sexual Offences (Scotland) Act 2009 with the alleged attack in Paisley, near Glasgow, on November 28, 2017.

His alleged victim was the first witness to give evidence in the case and said she had gone to bed on the night in question, leaving Jeffery and her brother listening to music in the living room.

She said she was texting her boyfriend while in bed and then fell asleep, adding: "I remember waking up with John in between my legs.

"I was lying on my back.

"I said, 'what are you doing?', then I moved out of the bed."

She said she was crying and walked to meet her friend, who said she needed to go to the police station.

She explained: "I was scared but at the same time I knew I had to.

"I gave the police officers my house keys because he was still in the house.

"My friend gave me some pyjamas to put on and my leggings and my jumper went straight into a bag for the police."

The court heard that swabs taken from the woman's body contained Jeffery's DNA and that he had also texted her in the early hours of November 29 apologising for what had happened.

The court heard the text read: "I'm so soz if I freaked you out.

"I just thought you might be wanting that.

"Don't freak out. I misread the signals.

"I'm so so soz."

Jeffery, of Kilmarnock, East Ayrshire, has lodged a special defence of consent and the trial, before Sheriff Seith Ireland, continues.
