The trial of a driver accused of causing the death of an elderly pedestrian is to take place before Christmas, a sheriff ruled today.
Mateusz Salamaj, 33, is said to have failed to notice Chris Morrison, 85, on the road, by not keeping the windscreen of his Renault Megane clear.
This restricted his view, it is alleged, and caused his car to collide with Mr Morrison on Cowane Street, Stirling, then a pedestrian on the roadway, causing the elderly man to be injured so severely that he died.
At a preliminary hearing at Falkirk Sheriff Court, Salamaj, of Whitburn, West Lothian, maintained his plea not guilty to a charge of causing the death of Mr Morrison, who was from Stirling, by careless driving, having failed to maintain proper observations.
He also faces a second charge of breaching motor vehicle construction and use regulations, because the reservoir of his windscreen washer was empty - an allegation which he also denies.
The incident is said to have happened on December 13th, 2019.
Sheriff Eric Brown set trial for a sitting commencing December 7th (2021).
