Royal Liverpool bosses looking at legal action over costly Carillion failures

Royal hospital bosses have taken advice on possible legal action over the circumstances that left its new hospital site with defects and facing years of delays.

Construction on the £335m new hospital was halted after construction giant Carillion, which was building as part of a PFI deal, collapsed in 2018.

It was later revealed that the hospital, which was thought to be almost finished, was covered in the wrong type of cladding and had serious structural defects, with costs to fix the problem estimated in the hundreds of millions.

The new hospital, which stands just metres from the current site, was due to be completed in 2017 but now won't open until 2020 at the earliest.

The Liverpool ECHO revealed earlier this year that millions has been spent just keeping the unused hospital maintained.

Work has now restarted, with a report to Liverpool Council's health and social care select committee saying around 385 workers were on the site.

And it revealed that the trust is working with the NHS and lawyers to examing whether there are any legal avenues the trust could go down to remedy the problems the new building has faced.

It says: "The National Audit Office is investigating the rescue of Carillion’s PFI hospital contracts and the trust has assisted the NAO in its investigation. The NAO report is due to be published in the next month.

"In addition, with the support of NHS Improvement, the trust has taken legal advice for potential legal redress to the inherited issues on the project."

Liverpool University Hospitals NHS Foundation Trust, a new trust formed earlier this year after its two predecessors merged, did not give any more details in the report about what form any future legal action would take.

However the update also revealed that major challenges remained in fixing the cladding on the building.

The report says: "The solution for the external cladding that needs to be removed is still being worked through with specialist advisors.

"There are significant challenges in ensuring that the existing cladding system can be fixed to meet compliance and the options being looked at have varying impact on the timescale and costs, which will be confirmed once the programme is finalised."

It says the next stage of the process, which involves installing 165 tonnes of steel framing into the building will begin in the coming months.

The Liverpool ECHO previously reported that the full business case for the remaining work at the Royal Liverpool Hospital will be presented to the Department of Health in the coming weeks.

The update on the Royal will be presented to councillors at the health and social care select committee next Tuesday.
