Roads are blocked until developer gets consent

A housebuilder has come under fire for building roads on a housing development without the proper consent.

Persimmon Homes has built a series of unauthorised roads at its Lathro Farm housing development in Kinross.

However, it has been revealed these roads have been constructed without road construction consent, which is an offence.

Perth and Kinross Council confirmed it closed off the roads yesterday. They will not be reopened until consent is officially granted to Persimmon Homes.

The council added the consent could take months to come through.

However, the roads leading to properties on the site that have already been sold are not included in this closure.

This is because the move-in dates for these properties are near.

Speaking on Tuesday, a spokesperson for the local authority said: “Perth and Kinross Council has issued a warning that unauthorised roads being constructed at the Persimmon Homes development site at Lathro Farm, Kinross will be fenced off and taken out of use from 10am on Thursday, June 13.

“Persimmon Homes is currently building homes at the Lathro Farm site in Kinross under a planning consent granted on March 31, 2017.

“The roads forming phase 1B at the west side of the site are being constructed without road construction consent.

“This constitutes an offence under section 23 of the Roads (Scotland) Act.

“The roads affected are between the houses which have already been built and the motorway.”

The spokesperson continued: “A notice warning of the closure [was out in place] on the site to allow time for trade vehicles and plant, etc. to be removed.

“This closure will remain in force until road construction consent has been granted [and] this may take several months.

“The roads concerned will be fenced off and periodic checks will be made to ensure the integrity of these are maintained.

“We are aware that some properties within this phase of housing have already been sold with move in dates imminent.

“A short section of the unauthorised road which provides access to these properties will not be included within this closure for the benefit of these new householders.”

A spokesperson for Persimmon Homes North Scotland said: “We can confirm that Persimmon has an approved road construction consent for the initial phase (phase 1A) of our Lathro Meadows development in Kinross.

“We would further confirm that all properties currently occupied on the development are served by roads which benefit from this road construction consent approval.

“The action which is proposed by Perth and Kinross Council relates to areas of the development in phase 1B which are currently under construction and does not impact upon our clients in occupied properties.

“We will continue to work closely with our colleagues at Perth and Kinross Council in assisting with the processing and determination of the road construction consent approval for phase 1B.”
