Restaurant owner left police officer with split lip after kneeing him in face

A restaurant owner left a police officer with a split lip after kneeing him in the face when he was arrested.

Altan Nur attacked the PCs when they detained his wife and daughter following a heated row with his ex-girlfriend. The businessman was so enraged that he had to be restrained using incapacitant spray.

Liverpool Crown Court heard today, Thursday, that police were called to his home on Crofton Road in Old Swan shortly before 11pm on February 26 last year after the situation became "volatile". Celia Pritchard, prosecuting, described how "emotions were heightened" and his partner and daughter were arrested.

Nur became "hostile and aggressive" as a result, shouting "hey you" at an officer before "charging towards him". The 52-year-old was taken to the floor, but continued to resist.

When being led into a van, he turned around and raised his knee - making contact with the mouth of a constable below him. He suffered a split lip as a result, as well as "pain and discomfort" to the jaw and a small bruise.

Pepper spray was then used "in order to get him under control". The court was played footage from police bodyworn cameras, which showed Nur screaming incoherently while on the ground and repeatedly being told to "relax" and "stay calm".

Under interview, the restauranteur initially denied lashing out at the officer. After being shown the video, he claimed he had been hit and admitted he "might have kicked out while he was falling".

Nur, who was defended by Jason Smith, has no previous convictions and one caution dating back 10 years. He was described as an "extremely hard-working and successful businessman" and is the owner of Defne, a Turkish BBQ restaurant with branches in Fazakerley and Childwall.

The dad admitted assaulting an emergency services worker and was handed an eight-month imprisonment suspended for two years. Nur was also told to pay £1,000 in court costs and a victim surcharge.

Sentencing, Recorder Ciaran Rankin said: "It appears you had been drinking. Following the arrest of members of your family, you confronted the police officers.

"You quite deliberately lashed out, and your knee connected with a police officer's face. Your behaviour was disgraceful.

"These officers were merely doing their public duty. Your loss of temper was out of character, but needs to be marked with a significant sentence.

"You are effectively a man of good character. You now recognise the police needed to attend and that you should have stepped back and not have got involved in the way you did."
